Terms of Use - AI Tools Platform

OBJECT

The purpose of these general terms and conditions of use is to define the conditions under which the User may access and use the AI Tools Platform.

DEFINITIONS

“User”: refers to any person with access to the AI Tools platform.
“AI Tools Platform” or “Platform”: refers to Kersia's internal “AI Tools” platform providing generative artificial intelligence tools.

ACCESS TO THE PLATFORM

Access to the AI Tools Platform is exclusively reserved for Kersia Group employees for internal use and for professional purposes only. Access to the Platform grants the User a personal and non-exclusive right of use. Any distribution, transfer, or provision of the Platform for the benefit of a third party is strictly prohibited.

Kersia strives to enable continuous access to the Platform, except in case of force majeure or an event beyond its control, and subject to possible breakdowns and maintenance interventions necessary for the proper functioning of the Platform.

In any case, Kersia cannot be held liable in the event of failure, breakdown, difficulty or interruption of operation, preventing access to the Platform or one of its features. Any User who does not comply with these general terms and conditions of use may have their access refused, suspended, or withdrawn.

TERMS OF USE

The artificial intelligence tools available on the Platform must be used for professional purposes only, and in accordance with the regulations and internal rules (in particular, the Code of Ethics, the Policy on the use of artificial intelligence tools, the IT Charter and the Personal Data Protection Policy).

It is especially strictly forbidden to use the Platform in a way that is likely to harm the interests of the group, its employees or third parties.

Any use for purposes other than those referred to in these terms of use is strictly prohibited.

INTELLECTUAL PROPERTY

Under no circumstances may these terms of use and, more generally, the use of the Platform, have the effect of transferring to the User any intellectual property rights over the input content, over the content generated by the Platform, or over the Platform itself. In any case, the content generated by the artificial intelligence of the Platform, unless it contains intellectual property belonging to a third party, is the full and complete property of Kersia.

The AI generates content based on public data, Kersia's own data as well as data entered by the User. It is possible that this data may be protected by intellectual property law. Therefore, for any AI-generated content, and prior to its use by the User, it is the User's responsibility to ensure that it does not infringe the intellectual property rights of a third party as well as Kersia's.

More generally, the User guarantees Kersia that its use of the Platform and its content complies with all applicable laws and regulations.

PERSONAL DATA & COOKIES

Please refer to the Personal Data Protection Policy and the Cookies Policy, available on the AI Tools Platform.

LIABILITY

Kersia is not responsible for any use that does not comply with these general terms and conditions of use. It is the User's responsibility to ensure that their use of the Platform complies with applicable laws.

Kersia does not grant any guarantee as to the availability of the AI Tools Platform for any reason whatsoever. Kersia may also be required, at its sole discretion, to interrupt access to the Platform temporarily or permanently, without compensation of any kind to the User and without any obligation to offer a similar tool.

Kersia cannot be held liable for the content and quality of the information provided to the User. It is the User's responsibility to review and verify the accuracy of the information provided by the AI and its suitability for the intended purpose.

The platform must only be used from devices provided by Kersia. In the event of access from a device belonging to the User or to a third party, Kersia cannot be held liable for any direct or indirect damage that may result from the User's access to or use of the Platform, or for any damage or virus that may affect the User's computer or any other device of the User.

MODIFICATION OF THE TERMS OF USE

Kersia reserves the right to modify, at any time and without notice, these terms of use in order to adapt them to changes in the Platform and/or the laws.

APPLICABLE LAW AND JURISDICTION

These general terms and conditions of use of the AI Tools Platform are governed by French law and subject to the jurisdiction of the courts of RENNES, unless a specific attribution of jurisdiction results from a particular law or regulation.
